Payment, Possession, and Unclaimed Animal Policy (Virginia)
Payment for all boarding, daycare, and related services is due at the time of pickup, unless otherwise agreed in writing.FidoPlay, LLC reserves the right to retain possession of any animal until all reasonable and customary charges for services rendered have been paid in full, as permitted under applicable Virginia law.Any animal for which full payment has not been made may not be claimed or released until the outstanding balance is satisfied. During any period of nonpayment, the animal shall remain in the custody of FidoPlay at the Pet Owner’s continued expense, and standard boarding and care charges shall continue to accrue.In the event an animal is not retrieved and paid for, such animal may be deemed “unclaimed” or abandoned in accordance with Virginia law, including but not limited to § 3.2-6520.If an animal remains unclaimed for a period of fourteen (14) days after the agreed pickup date or after notice to the owner, FidoPlay may, in accordance with § 3.2-6520 of the Code of Virginia, take lawful action including but not limited to:Transfer to a shelter or rescue organizationPlacement for adoptionSale or other lawful disposition, where permittedThe Pet Owner acknowledges that failure to pay for services and retrieve the animal may result in the termination of ownership rights to the extent allowed by law, and that the Pet Owner remains liable for all charges incurred prior to such disposition.Any disputes regarding charges, possession, or ownership of the animal, including claims for detinue or recovery of property, shall be resolved through the appropriate civil courts, and not by self-help or interference with the lawful custody of FidoPlay.
FidoPlay, LLC Boarding & Daycare Agreement
This Boarding & Daycare Agreement (“Agreement”) is entered into by and between FidoPlay, LLC (“FidoPlay”) and the undersigned pet owner (“Pet Parent”). By booking or utilizing FidoPlay’s services, Pet Parent agrees to the following terms:
1. Liability & Veterinary Care
Pet Parent understands that participation in daycare, boarding, and related services involves inherent risks, including but not limited to injury, illness, or death.FidoPlay and its staff shall not be liable for injury, illness, or death of any pet, except where required by law.If a pet becomes ill or injured while in FidoPlay’s care:FidoPlay is authorized to seek veterinary treatment if deemed necessaryFidoPlay may transport the pet to a veterinarianFidoPlay will contribute up to $200 toward veterinary careAny costs exceeding $200 are the sole responsibility of the Pet ParentPet Parent authorizes FidoPlay to obtain medical care if the Pet Parent cannot be reached.
2. Behavior & Dismissal Policy
FidoPlay reserves the right to remove any pet from daycare, boarding, or group play at any time for safety or behavioral concerns.No refunds will be issued for early removalFidoPlay may permanently refuse service to any pet or Pet Parent at its discretion
3. Temperament Requirements
All pets must pass a temperament evaluation prior to participation. This may occur:Prior to boardingAt drop-offDuring a trial daycare visitFidoPlay reserves the right to deny services based on temperament or safety concerns.
4. Nail Maintenance
All pets must have safely trimmed nails.If a pet’s nails are deemed unsafe:FidoPlay may perform a nail trim using a DremelA $10 fee will be charged
5. Vaccination Requirements
Pet Parent agrees to:Provide proof of current vaccinations:RabiesBordetellaDistemperMaintain up-to-date records at all timesFailure to comply may result in denial or termination of services.
6. Female Dogs in Heat
Female dogs in heat are not permitted.If a dog enters heat during its stay, the Pet Parent must arrange immediate pickup.
7. Payment Terms
Boarding is payable in advance, unless otherwise approved“Pay at pickup” requires:Minimum four (4) night stayValid card on fileAll charges are subject to the Payment, Possession, and Unclaimed Animal Policy incorporated into this Agreement.
8. No Refund Policy
No refunds or credits will be issued for:Early pickupUnused boarding/Daycare timeBoarding may be extended subject to availability.
9. Additional Charges
FidoPlay may apply additional fees, including:Enhanced Care Fee For pets requiring excessive supervision, time, or resources:Up to $20 per pet, per nightDetermined at FidoPlay’s discretion
10. Billing Authorization
Pet Parent authorizes FidoPlay to charge the card on file for:Boarding and daycare servicesRecurring plans or subscriptionsOutstanding balancesAdditional services (including nail trims and enhanced care)Pet Parent agrees to maintain valid payment information at all times.
11. Conduct Policy
Pet Parents and staff are expected to interact respectfully.FidoPlay may immediately terminate services if:A Pet Parent behaves in a hostile or inappropriate mannerA pet presents ongoing safety risks
12. Representations of Pet Parent
Pet Parent certifies that:The pet is in good healthThe pet is free from contagious illnessAll provided information is accurate and complete
13. Entire Agreement
This Agreement, together with any incorporated policies, constitutes the entire agreement between the parties.By utilizing FidoPlay’s services, Pet Parent acknowledges that they have:ReadUnderstoodAgreed to all terms and conditions
